CONDITIONS OF BUSINESS
DOG-WALKING AGREEMENT
This contract between Lakes & Fells Dog Walking Company and the Client becomes binding upon the commencement of the provision of dog walking or dog care services.
I (the Provider) offer a dog-walking service to you (the Client) on the following terms. References to ‘Dog’ are to the Client’s dog or dogs.
1. TERMS OF AGREEMENT
1.1. The Provider will walk the Dog(s) as agreed at the time and on the specific days agreed from the Client’s address, unless another address is agreed.
1.2. The Provider will not walk other suitable and compatible dogs at the same time as the Client’s Dog(s) without prior agreement.
1.3. The booked time starts from when the Provider arrives at your physical address. Each walk will be 10 minutes less than the allotted booking slot to allow for rub down, cuddles, provision of fresh water and/or snack, etc. to support the general welfare and happiness of the Dog(s).
1.4. The Client will either ensure that access is given to the Provider to collect the Dog(s) from the agreed address at the agreed times, or give the Provider a key or an entry code for independent access.
1.5. The Provider will use the key or entry code to collect and return the Dog(s) and for no other purpose. Keys and entry codes will be kept confidential and secure at all times. Keys will be returned to the Client on demand and record of entry codes destroyed.
1.6. Whilst the Provider shall make every effort to arrive at the mutually agreed time, please allow an additional 30 minutes for difficult road conditions or unforeseen circumstances.
1.7. Adverse weather conditions can seriously delay or hamper service provision, yet the Provider will strive to operate as normal.
1.8. In the event of serious weather conditions, such as ice, the Provider retains the right to dramatically shorten walks to preserve the safety of both Provider and Dog(s). Any unspent time walking will be transferred to playtime indoors to the expiration of the booking time.
1.9. Clients must prior inform the Provider if they or a third party are to be on the premises at the point of collection or drop-off.
2. RELATIONSHIP & RESPONSIBILITIES
2.1. The Client will supply suitable collars or harnesses and lead for the Dog(s) and any coats or other accessories, which the Client wishes to be used. The Provider is entitled to refuse to walk the Dog if a suitable (safe and secure) collar or harness or lead, and outdoor jacket for inclement weather, are not provided. Yet, payment in full will be required as though that walk had taken place.
2.2. The Client will fully inform the Provider of any characteristics of the Dog(s) which needs to be known for the handling and general care of the Dog(s); this includes, aggression, health issues, sudden personality changes, or recent incidents. This extends to consulting third parties, such as veterinarians or animal professionals, about behavioural issues.
2.3. The Provider will inform the Client of any and all incidents or anything untoward, about the Dog’s behaviour, health, or incidents involving other animals or people.
2.4. The Provider will keep the Dog(s) on a lead unless prior arrangement has been made to walk the dog/dogs off lead away from their physical address of collection.
2.5. The Provider will take care so far as is practicable that the Dog is not a nuisance or danger to people, or any other animals, and that no harm comes to him/herself, or others.
2.6. The Provider retains the right to shorten a walk should the dog’s behaviour become worrisome, aggressive, agitated, unruly, or poses a health risk to him/herself, or the Provider. Full payment will still be required.
2.7. The Provider shall not be obliged to perform any other duties except those agreed. Thus, should a dog, for instance, create a domestic disturbance, engage in destruction, or soil within their physical address, the Provider is not obliged to rectify the situation; it is left to the Provider’s discretion and time constraints. Should the Provider set about rectifying a situation, the time will be deducted from the booking slot, and if it goes beyond the agreed booking slot, an additional charge will be payable commensurate with the dog walking fees.
2.8. The Provider will remove the Dog’s faeces from public and dispose of it safely, to thus abide by the law and also public health considerations.
3. LIABILITY
3.1. The Client accepts full liability for any loss or damage caused by their Dog(s) whilst being walked or cared for. This includes injury to, and death of the Dog(s).
3.2. The Provider is not held accountable for veterinary fees or third party claims whilst the Dog is in our care or thereafter.
3.3. The Provider is not liable for any mishap or accident, which may befall a Dog or caused by a Dog, who is unsupervised whilst the Client is away from the physical property when the Provider is scheduled to walk or care for the Dog on that date.
3.4. The Client shall be liable for all medical expenses and damages resulting from an injury to the Provider caused by the Dog(s) as well as damage to the Client's own property.
3.5. The Provider accepts no liability for any breach of security or loss of or damage to the Client's property.
3.6. The Provider is released from all liability related to transporting Dog(s) to and from any veterinary clinic, the medical treatment of the Dog(s), and the expense thereof.
4. BOOKINGS & PAYMENT
4.1. Bookings can be contractually made by text message, email, and orally. Once made, bookings are biding. Not less than 72 hours notice must be given to cancel any booking.
4.2. The Provider’s non-negotiable chargeable rates can be found at www.poshpoocheswalk.com/services.html
4.3. Not less than 4 weeks’ notice will be given for price increases.
4.4. All dog care services provided by Posh Pooches Walk must be paid in full by the end of the working week (Friday). Should payment not be made within 5 days, or the end of the working week (Friday), Posh Pooches Walk will add a late payment fee of ten pounds onto the outstanding bill.
4.5. The Provider retains the right to refuse to provide a dog walking or pet sitting service if monies remain outstanding by the following Monday, or can terminate the contract with immediate effect.
5. EMERGENCIES
5.1. In the event of an emergency, the Provider shall contact the Client at the numbers provided to confirm the choice of action. If the Client cannot be reached timeously, the Provider is authorised to:
5.2. Transport the Dog(s) to the listed veterinarian;
5.3. Request on-site treatment from a veterinarian. We reserve the right to make decisions regarding your Dog’s health provided it is at all times acting in the best interests of the Dog and also on the advice of a veterinary surgeon.
5.4. Transport the Dog(s) to an alternative clinic if the previous two options are not feasible.
6. COMPLAINTS
6.1. Complaints, with full details, must be forwarded in writing at the earliest convenience to facilitate a swift response and investigation if necessary.
7. CANCELLATION OR EARLY TERMINATION
7.1. The Provider requires not less than 72 hours’ notice to cancel dog walking or pet sitting. Failure to provide such notice incurs the full cost of the dog walk or dog sitting session.
7.2. The Provider retains the right to cancel the contract with immediate effect should the Client cancel 2 or more dog walking or pet sitting sessions without adhering to the 72 hour notice rule.
7.3. Should any Dog become aggressive, dangerous, a public nuisance, or uncooperative, the Provider may terminate the contract with immediate effect.
7.4. The Provider retains the right to cancel the contract with immediate effect should the Client cancel a booking, in order to have the Dog(s) walked/cared for by another dog care provider.
7.5. Either party may terminate this contract by not less than 72 hours notice.
